EmpowerSecure provides AI automation consulting, technology advisory, website development, lead management, and related professional services for businesses. Our services include but are not limited to:
- AI readiness assessments and automation projects
- Virtual CIO (vCIO) advisory services
- Website design, development, and management for clients
- AI-powered chatbot and lead capture tools embedded on client websites
- SMS/MMS notifications, email communications, and follow-up sequences
- Workplace violence prevention software (Guardian Shield)
- AI compliance assessments and advisory
2. AI-Powered Chatbot
Our websites and client websites may feature an AI-powered chatbot. By using the chatbot, you acknowledge and agree that:
- The chatbot is powered by artificial intelligence and is not a human.
- The chatbot is designed to help answer general questions and collect your contact information so a human team member can follow up.
- The chatbot does not provide legally binding quotes, warranties, guarantees, or professional advice. Any pricing, timelines, or service commitments are subject to confirmation by a human representative.
- Information you provide to the chatbot (including name, phone, email, and project details) will be collected and may be used to contact you regarding your inquiry.
- Chatbot conversations may be recorded and stored for quality assurance and service improvement.
- AI-generated responses may contain errors or inaccuracies. We are not liable for actions taken based solely on chatbot responses.
3. SMS/MMS Communications
3.1 Consent to Receive Messages
By providing your phone number through a contact form, chatbot conversation, or other means and consenting to receive text messages, you expressly agree to receive SMS/MMS messages from EmpowerSecure or the service provider whose website you submitted your inquiry through. These messages may include:
- Confirmation of your inquiry
- Follow-up messages regarding your project
- Appointment reminders and scheduling notifications
- Service updates
3.2 Message Frequency and Rates
Message frequency varies. Typically 1-5 messages per inquiry. Message and data rates may apply depending on your mobile carrier and plan. EmpowerSecure is not responsible for carrier charges.
3.3 Opt-Out
You may opt out of SMS/MMS messages at any time by replying STOP to any message, emailing [email protected], or calling (540) 569-9282. Consent to receive SMS messages is not a condition of purchasing any goods or services.
3.4 No Sale of Phone Numbers
We will never sell, rent, or share your phone number with third parties for their marketing purposes. Your phone number is used exclusively for the communications described in these Terms and our Privacy Policy.
4. Email Communications
By providing your email address, you consent to receive transactional and service-related emails, including inquiry confirmations, project updates, invoices, and appointment reminders. You may opt out of marketing emails at any time by clicking the "unsubscribe" link in any email or by contacting us directly. Transactional communications (invoices, security alerts, appointment confirmations) cannot be opted out of while you have an active service relationship.
5. Payments and Billing
Payments for services are processed through Stripe, a PCI DSS-compliant payment processor. By making a payment, you agree to Stripe's Terms of Service. All fees are stated in U.S. dollars. Payment terms, schedules, and amounts are specified in your service agreement or invoice. Refund policies are determined on a per-engagement basis and outlined in your service agreement.
6. Intellectual Property
All content on our websites — including text, graphics, logos, design, and software — is the property of EmpowerSecure LLC or its licensors and is protected by U.S. copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our prior written consent. Client deliverables (websites, reports, assessments) become the property of the client upon full payment as specified in the applicable service agreement.
7. Acceptable Use
You agree not to:
- Use our services for any unlawful purpose
- Submit false, misleading, or fraudulent information through contact forms or chatbot
- Attempt to gain unauthorized access to our systems, networks, or data
- Interfere with or disrupt the operation of our websites or services
- Use automated tools (bots, scrapers) to access our services without prior written permission
- Impersonate any person or entity in communications with our chatbot or team
- Transmit malicious code, spam, or harmful content through any channel
We reserve the right to suspend or terminate access to our services for violations of these Terms.
8. Client Websites and Third-Party Services
EmpowerSecure builds and manages websites for clients (such as contractors and small businesses). When you interact with a client's website that we manage:
- Your inquiry and contact information will be shared with that client so they can respond to you
- The client is responsible for their own business practices, pricing, service delivery, and customer interactions
- EmpowerSecure is not a party to any agreement between you and the client
- Our role is limited to managing the technology platform and lead routing
9. Disclaimers
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that our websites or services will be uninterrupted, error-free, or secure. We do not guarantee the accuracy, completeness, or reliability of any content, including AI-generated chatbot responses.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMPOWERSECURE LLC, ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.
Our total aggregate liability for any claims arising under these Terms shall not exceed the total amount you have paid to EmpowerSecure in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless EmpowerSecure LLC, its owners, officers, employees, and agents from any claims, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising out of your use of our services, your violation of these Terms, or your violation of any third-party rights.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Augusta County, Virginia, and you consent to the personal jurisdiction of such courts.
Before initiating formal legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation. If negotiation fails, either party may pursue mediation before filing suit.
13. Termination
We reserve the right to suspend or terminate your access to our services at any time, with or without cause, with or without notice. Upon termination, your right to use our services ceases immediately. Sections 9, 10, 11, and 12 survive termination.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
15. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a revised "Last updated" date. Your continued use of our services after changes are posted constitutes your acceptance of the revised Terms.
